Privacy Policy

Synergyne ART Analytics Inc. (hereinafter referred to as ‘Synergyne’) is committed to protecting your patient’s personal information and personal health information. Synergyne is bound by law to ensure clinic, patient personal and personal health information is protected. 

Definitions:

  • Personal Information: This refers to information about an identifiable individual, which may include, but is not limited to, name, contact details (e.g., email address, phone number), and any other information that can be used to identify an individual. 
  • Personal Health Information: This specifically includes information about an identifiable individual’s physical or mental health, medical history, diagnosis, treatment, and care, as well as medical images and reports generated from such images. This encompasses information provided by your clinic/clinician for diagnostic services. 

Purpose of Collection, Use, and Disclosure:

Synergyne collects, uses, and discloses your patient’s personal information and personal health information solely for the following purposes: 

  • To provide diagnostic services (the “Services”) related to ultra-sound images to assist clinics and clinicians in making decisions for patients undergoing ART therapies, as further detailed in our Terms of Use. 
  • To generate and deliver AIM™ Test Reports to registered clinics/clinicians via our secure portal. 
  • To ensure the proper setup of clinic ultrasound equipment and facilitate the secure transfer of patient images. 
  • To conduct internal quality assurance, service improvement, and research related to the Diagnostic, while maintaining patient anonymity where possible. 
  • To comply with applicable legal and regulatory requirements. 
  • To manage billing and invoicing for the Services provided to clinics. 

Synergyne operates its business and stores its data in Canada and, as such, complies with all applicable federal and provincial privacy laws (specifically those applicable in British Columbia, Alberta, Saskatchewan and Ontario) including the federal Personal Information Protection and Electronic Documents Act (PIPEDA).   

Synergyne is bound by law to ensure clinic, patient personal, and personal health information is protected. Synergyne complies with all applicable federal and provincial privacy laws, including the federal PIPEDA.  For personal health information, Synergyne also complies with specific provincial legislation, including: 

The Health Information Protection Act (Saskatchewan) (HIPA) (where applicable) 

The Health Information Act (Alberta) (HIA) (where applicable) 

The Personal Health Information Protection Act (Ontario) (PHIPA) (where applicable) 

Synergyne is committed to maintaining the accuracy, confidentiality, and security of such information. 

Consent:

By submitting patient personal information and personal health information to Synergyne through our secure portal, the Clinic confirms that it has obtained all necessary consents from the patient, in accordance with applicable federal and provincial privacy laws (including PIPEDA, HIPA, HIA, and PHIPA where applicable), for the collection, use, and disclosure of their information by Synergyne for the purposes outlined in this Privacy Notice and our Terms of Use. For sensitive personal health information, express consent is generally required. Patients may withdraw their consent under certain circumstances, subject to legal or contractual restrictions and reasonable notice. If a patient withdraws consent, the Clinic must promptly notify Synergyne, which may impact our ability to provide Services to that patient. 

Clinic customers who operate outside of Canada are responsible for ensuring compliance with the privacy laws of such jurisdictions.  Synergyne makes no representations nor assumes any liability for non-compliance with the privacy laws of jurisdictions outside of Canada.   

Synergyne’s data for clinical customers located in the United States are stored in compliance with U.S. federal laws on a separate and secure server maintained for U.S. patient data.  By providing personal information, the user acknowledges that the U.S. patient data may be subject to the USA PATRIOT Act, which could allow U.S. authorities to access your information for counter-terrorism investigations. Synergyne is committed to maintain the accuracy, confidentiality and security of such information. Our systems safeguard personal information using methods commensurate with the sensitivity of the information. Only personnel that need to see personal health information and/or personal information have access to that information. All healthcare professionals and employees of Synergyne are subject to confidentiality agreements and must comply with our safeguards and protocols. We maintain physical, technical and procedural safeguards designed to prevent sensitive information from theft, loss and unauthorized access, copying, use, modification, disclosure or disposal. 

Patient Rights Regarding Their Information:  

Patients may have the right to access their personal information and personal health information held by Synergyne and to request corrections to any inaccuracies. All such requests should be directed to the Clinic where the patient received services. The Clinic will then facilitate these requests with Synergyne in accordance with our agreement and applicable privacy laws. Synergyne will provide access to or correct personal information where it deems appropriate and where required by law. 

Retention of Information:  

Synergyne retains personal information and personal health information for as long as necessary to fulfill the purposes for which it was collected, to provide ongoing Services to the Clinic, and to comply with legal, accounting, and regulatory requirements. Once no longer required, information is securely disposed of in a manner that prevents unauthorized access. 

Data Security and Breach Notification:

While Synergyne employs robust physical, technical, and procedural safeguards to protect your information from theft, loss, and unauthorized access, copying, use, modification, disclosure, or disposal, no system is entirely impenetrable. In the unlikely event of a privacy breach involving personal information or personal health information that poses a real risk of significant harm, Synergyne will comply with all applicable mandatory breach notification requirements under federal (PIPEDA) and provincial privacy laws (e.g., HIPA, HIA, PHIPA), including notifying affected individuals and the relevant privacy commissioner(s) as required by law. 

Disclosure to Third Parties:

Synergyne does not sell or rent patient personal information or personal health information. We may, from time to time, engage trusted third-party service providers (e.g., for secure cloud hosting, data processing, etc.) to assist us in delivering our Services. In such cases, these third parties are contractually bound to maintain the confidentiality and security of the information and to use it only for the purposes for which it was disclosed, in accordance with Synergyne’s privacy standards and applicable laws. All such service providers are carefully vetted to ensure they adhere to stringent security and privacy protocols. We will not disclose personal information or personal health information to any other third party without your consent or as required or permitted by law.   

Non-identifiable ultrasonic image data may be used to develop, modify, improve or create Synergyne’s algorithms from time to time.   

We may revise Synergyne’s privacy practices and policies and this notice from time to time as regulations change. Further, the clinic or clinician may request a copy of the Notice currently in effect at any time.
